FOSA LOGOCONSTITUTION OF

FEDERATION OF OKUNMO STUDENTS’ ASSOCIATION (FOSA)

GENERAL PREAMBLE

This instrument shall be referred to as the constitution of Federation of Okunmo Students’ Association, Okitipupa, Ondo State, Nigeria. The aims and the ideals of this Association shall be determined and regulated by articles of this constitution.

The members having solemnly and firmly resolved to uphold and abide by the rules and regulations of this noble Association and to provide co-ordination and the principle of freedom, equality and justice for the purpose of consolidating the unity of the members, do hereby make, enact and have agreed that the following herein set out Articles, Section, Sub-sections, shall be the main guide for members of the Association.

ARTICLE I

SECTION A: SUPRMACY OF THE CONSTITUTION

Sub-Section:

  • This constitution shall be supreme and its provision shall be binding on every member of the Association, regardless of his/her position, status and rank in the Association.
  • Any alteration on the part of whole shall be declared NULL and VOLD. This is unconstitutional.
  • If any law(s) or norms within the Association which is inconstant with the provision of this constitution, shall be void to the extent of its inconsistency.
  • Where the constitution is silent on any issues, the house shall rule out such decision until an amendment is made in that aspect in the constitution.

 

SECTION B: NAME

Sub-Section:

  1. The Association shall be known and called, FEDERATION OF OKUNMO STUDENTS’ ASSOCIATION (FOSA).
  2. The Association shall be the central body of all the Okunmo Students’ in Okitipupa, Ondo State, Nigeria.
  • Motto: Liberate, Elevate and Advocate.

 

ARTICLE 2

SECTION A:     AIMS AND OBJECTIVES

Sub –Section:

  1. To promote the development of FOSA
  2. To stand and serve as a source of inspiration to our brothers and sisters in the Association.
  • To promote fundamentals human rights at their members and maintain discipline among members.
  1. To supplement the efforts of the members by embarking on programmes for the advancement of education within the jurisdiction.
  2. To promote public awareness and mutual understanding with the members and the community.
  3. To encourage freedom of thought and expression and to encourage good relations among members of the Association and the nation.
  • To promote the social, cultural, intellectual and moral activities of its members.
  • To foster unity amongst member of Okunmo Students.
  1. To educate student and eradicate all acts of hooliganism.
  2. It shall act back as the parent body incase of any disagreement.

 

SECTION B:     MEMBERSHIP

Sub-Section:

  1. Membership shall be open to all Okunmo Students irrespective of their level of education.
  2. Membership shall not be optional and willing person(s)shall not become member(s) unless, He/She they satisfy sub-section (i) of section B.
  3. Membership of this Association shall be address as COMRADE
  4. He/She must be of good behavior, must attain a standard acceptable by the Association and the society.
  5. For the sustenance of membership, such persons shall be financing members.
  6. An expelled student who is proved beyond all reasonable doubts shall not be member.

 

ARTICLE 3

SECTION A:         RIGHTS AND PRIVILIGES OF MEMBERS

Sub-Section:

  • Every member shall participate in recognized meeting and function of the association.
  • Every member must have the right to contribute meaningfully to the development and progress of the association.
  • Every member shall have the right to obey the rules and regulations of the Association.
  • All financial members shall have the right to vote and be voted for in any approved election of the Association.
  • Shall have the right to voice out opinion, make useful reasonable and construction suggestion and criticism, but shall abide by majority resolutions on issues.
  • Shall have the right to scrutinize any official record kept by the executives at general meeting(s)
  • Shall have the right to enjoy all facilities that may be provided by the Association.
  • Shall have inquiry from affected officers any issues relating to his office in the Association.
  • Every member shall have the right to call or invite all members of the Association for outing and ceremonial if need be to forward a letter to the Association is very essential before the date.
  • In case of the member abuse the right to enjoy all facilities provided by the Association such member shall be referred to the disciplinary committee for appropriate action.

 

ARTICLE 4

SECTION A:     POWERS OF THE HOUSE

Sub-Section:

  1. The general meeting herein reformed to as the House shall, have the final decision on all matters.
  2. Shall elect all the officers of the Association
  • Shall consider and approve the annual budget of the Association.
  1. Treat all case or cases, recommendations brought before it by the executive council.
  2. Adopt on reject decisions of the executive council by voting with at least 2/3 majority when quorum is deemed to have been formed.
  3. Shall have the power to enforce the payment of other levies including the annual dues on members.
  • Setting up committed to perform some specific duties or assignment.
  • Ratify the capital project of the Association.

 

 

 

SECTION B:     POWERS OF THE EXECUTIVE COUNCIL

Sub-Section

  • The executive shall organize for the orientation/welcoming party of new members.
  • Shall plan and organize for the Association’s Anniversary other activities approved by the House.
  • Shall represent the good interest of the Association at the community and outside.
  • Shall do such other things to guarantee the effective running at their government provided such act or acts does not contravene the provisions of this constitution.
  • Draw up programme(s) of activities for ratification by the general house.
  • Any other functions that may promote comraship of the members of the community as well as in the Association.

 

 

 

 

 

 

 

 

 

 

 

ARTICLE 5

SECTION A: OFFICERS OF THE ASSOCIATION

Sub-Section:

  • Officers of the Association shall consist of 11 elected officers as thus:
  1. The President
  2. Vice-President
  3. Secretary General
  4. Assistant Secretary General
  5. Financial Secretary
  6. Treasurer
  7. Public Relation Officer
  8. Editor-in-Chief
  9. Auditor
  10. Welfare officer

ARTICLE 6

SECTION A:    DUTIES OF THE PRESIDENT

Sub-Section

  1. Shall be the primus inter-pares in the Association.
  2. Shall preside over the meeting of both the executive council and the general meetings of the Association.
  • Shall have the power to suspend or postpone any issue(s) under discussions in the interest of peace and tranquility and in the interest of the Association.
  1. Shall summon the general and executive meeting in consultation with the secretary General and Public Relation Officer (PRO).
  2. Be answerable for the performance of the executives.
  3. Summon emergency meetings of both the general and executive in consultation with other executive.
  • Be a signatory to the bank accounts of the Association
  • Shall protect the image of the Association in accordance with the provision of this constitution.
  1. Shall co-ordinate the activities of other executives in the Association.
  2. Shall discharge all other duties that may be divided to him/her from time to time for effective performance of the Association.
  3. Shall be directly responsible to the Association in all its complexities and shall co-ordinate and liaise effectively with other executive members of the Association
  • Shall among other things give annual report on the Association’s activities.
  • Shall cast his vote wherever, and whenever necessary, i.e. he or she shall have the deciding vote in the case of deadlock.
  • Shall query any erring officer(s) and subsequently report to the House.

 

ARTICLE 7

SECTION A:             DUTIES OF VICE PRESIDENT

Sub- section:

  1. Shall deputies for the president at any meeting and perform all the functions of the president in his\her absence.
  2. Shall co-ordinate all the chairman of the executive in the absence of the president.
  • Shall advice and assist the president in performance hid/her duties.
  1. Shall carry out all such activities that may by the delegated to his/her from time to time by the Association.

 

ARTICLE 8

SENTION A: DUTIES OF SECRETARY GENERAL

Sub-section:

  1. Shall responsible for all correspondence as directed by the Association.
  2. Implement the decision of the Association.
  • Convene the meetings as may be directed by the president.
  1. Shall takes the minutes of the Association.
  2. Shall be present in all general meeting of the Association.
  3. He/she is the record keeper of the Association.
  • Shall protect the image of the Association in accordance with the Association.
  • Shall discharge other duties that may be divided to him/her from time to time for effective performance of the Association.
  1. Shall perform all other secretariat functions of the Association.

 

 

 

ARTICLE 9

SECTION A: DUTIES OF ASSISTANT SECRETARY GENERAL

Sub-section:

  1. Shall assist General Secretary in all his/her functions especially by writing down minutes of meetings.
  2. Shall act for secretary General in his/her absence.
  • Shall perform such other duties as may be assigned to him/ her by the Association.

 

 

 

 

 

ARTICLE 10

SECTION A: DIRECTOR OF FINANCE (FINANCIAL SECRETARY)

Sub-section:

  1. Shall be responsible for collecting all subscription and dues from members and paying such subscriptions and due give them to the Treasurer within 48 hours of receipt.
  2. Shall initiate procedures that will ensure adequate flow of revenue to the association.
  • Shall ensure that all the monies collected are properly receipted.
  1. Shall be the chairman of fund raising committee of the Association
  2. Shall be the custodian of cheque book/passbook and any other monetary document.
  3. Shall submit his account books and other fiscal particular to the Auditors for proper checking when requested for.
  • Shall keep and maintain an accurate and up to date account of all income and expenditure of the Association.
  • Shall prepared and present the financial report of the Association at least once in a year, during the meeting of the end of the year.
  1. Shall be signatory to Association’s bank Account.

 

 

 

ARTICLE 11

SECTION: A. DIRECTORY OF TREASURY (TREASURER)

Sub-Section

  1. Shall take delivery of all Association’s monies from all sources and deposit such monies with the Association’s Bankers within 48 hours of receipt except money received on Friday, which shall be deposited within 72 hours.
  2. Shall keep records of all monies received, deposited or withdrawn on behalf of the Association.
  • Shall submit a written statement of the Association’s account at the end of the year.
  1. Shall be a signatory to the Association’s bank account.
  2. Shall have power to keep imprest account not exceeding one thousand naira (N1000.00) incase of emergency.
  3. Shall submit his account book and any other particulars to the Auditors for proper checking on request.
  • Shall be responsible for the proper accounting and control of fund.

 

 

 

 

 

 

 

 

ARTICLE 12

SECTION: A.   DUTIES OF PUBLIC RELATION OFFICER (P.R.O)

Sub-Section

  1. Shall be responsible for publishing the various activities of the Association having to do with the public and outside the community as laid down by the Association.
  2. Shall circulate the notice of meeting for the general and executive meeting.
  • Shall arrange for the social activities of the Association.
  1. Shall be responsible for public enlightenment of members and for the purpose, organize, lecture symposia, etc.
  2. Shall keep record of such or press reports relating to the Association for references purposes.

 

ARTICLE 13

SECTION: A.  DUTIES OF DIRECTOR OF SOCIAL AFFAIRS

Sub-Section:

  1. Shall responsible for organizing all social activities of the Association
  2. Shall be the Chairman of all social committee
  • His/Her duties shall cover welcome party orientation, anniversary, send-off party and any other social activities assigned to his/her office by the Association.
  1. Shall be the custodian of Association’s electronic gadgets.
  2. Shall responsible for entertainment during any meeting, the money for which he/she will use will be collected from Director of Treasury with the consent of the Present Director of Finance.
  3. Shall perform all other duties as may directed by the President in conjunction with the Executives.

 

ARTICLE 14

SECTION: A.    DUTIES OF EDITOR-IN-CHIEF

Sub-Section:

  1. Shall be an automatic member of the Association’s Executive.
  2. Shall edit all articles, magazines, journals, handbooks, leaflets etc before the Association press board or publication.
  • Shall Chairman the Editorial Crew
  1. Shall be elected from among and by the Editorial Crew.

 

ARTICLE 15

SECTION: A.    DUTIES OF CHIEF WHIP

Sub-Section:

  1. Shall Chairman the disciplinary committee
  2. Shall have the final say on disciplinary matters subject to the approval of the General House.
  • Shall maintain orderliness in the Association especially during meetings.
  1. Shall count the number of votes in time of votes in time of bye-election.
  2. Shall have power to deal appropriately with any offensive/indiscipline action(s).
  3. Collect the time, during meetings as pronounced by the Executives and General House.

 

ARTICLE 16

SECTION A: DUTIES OF AUDITORS

Sub-Section:

  1. Shall be appointed at the General meeting to Audit the account of Association whenever the need arises.
  2. Shall be three (3) Auditors for the Association who shall be an independent body.
  3. Shall examine all the books and other relevant properties of the Association.
  4. He/She may question any officers of the Association on financial matters.
  5. Shall submit a report of the audited account to the General House.
  6. Shall prepare release of the Association’s activities and send some to the news media subject to the approval of the Association.
  7. Shall carry out any other duties that may be assigned to him/her by the Association.

 

 

 

 

 

ARTICLE 17

SECTION A: EDITORIAL CREW

Sub-Section:

  1. The editorial crew shall be set up by the General meeting of the Association; such people must be selected from the Association.
  2. The crew shall consist of not more than five (5) and not less than three (3) members.
  • The Editor-in-Chief who shall chairman the crew shall be chosen by the crew.
  1. The Editor-in-Chief shall hold the key to the Association notice board.
  2. Shall be independent body under F.O.S.A.
  3. Shall publish magazine, article, handbooks, journals etc. of the Association.

 

ARTICLE 18

SECTION A:       FINANCE

Sub-Section:

  1. There shall be annual subscription to be determined by the General House, in cognizance with the state of the economy.
  2. Annual dues shall be compulsory and the executive council shall do any thing(s) to retrieve the due from all members.
  • The President, Financial Secretary and Treasurer shall be the officials signatories for the withdrawal from the Association’s Account.
  1. Rendering of the Association’s Account shall be done on yearly basis.
  2. Association shall generate fund from Donations from the Patrons, Patronesses, Advisers, and Spiritual Leaders etc.
  3. Shall generate fund from the profit acquired from social activities.
  • Shall generate fund from Donations and grant made to the Association by external bodies.
  • Shall generate fund from voluntary Donation from members of the Association.
  1. There shall be a fund raising committee.

 

ARTICLE 19

SECTION A: CODE OF CONDUCT AND DISCIPLINE

Sub-Section:

  1. (a) Executive who fails to show up at the executive meeting three   times without prior notice (information) to that body shall take disciplinary action. (b) If guilty such an officer be dismissed from the office and bye-election shall be order by the general house.
  2. Use(s) of offensive words during the executive and General meeting is strictly prohibited and whoever is guilty of this shall be made to withdraw such an offensive words and apologize.
  3. For anybody whose words and action is capable of bringing disrepute into the Association both within and outside the Association and if find guilty by the disciplinary committee after a fair trial shall write letter of apology.
  4. Any member who fails to fulfill his/her financial obligation at the stipulated time is liable to face disciplinary committee for appropriate disciplinary measures.
  5. Participation in the Association shall be seriously considered in appointing anybody to a responsible post.
  6. The member of executive shall be removed if it is established that he/she: (a) fails to perform the duties of his or her office (b) suffers from serious physical infirmity (c) has under any law in force, been convicted of a criminal offence. (d) engages in activities in becoming of his/her office, thereby bringing the association into ridicule, embarrassment and disrepute.
  7. No member shall act in violation of the constitution.
  8. No member shall do anything contrary to the aims and objectives of the Association.
  9. The defaulting officer should not be allowed to sit as one of the presiding officer in determine of his/her guilty.
  10. All executive members must support such discipline action to be taken against officer, the officer to be tried exclusively.
  11. Before any action, the recalcitrant member shall be allowed to defend his/her self, the saying hear both side’s to a dispute.
  12. If any members found guilty of misappropriation, embezzlement of the Association’s fund shall be made to pay back the amount and shall either suspended or other disciplinary measure as may be directed by the Association.
  13. Association shall appoint a high power and independent committee to look into any allegation preferred against any member and officer.
  14. The committee shall submit it report to the Association within the time stipulated and the decision of the Association shall be final.
  15. No member should exchange blow (fight) during or immediately after meeting both General and Executive meeting if any member violate this rule shall face disciplinary measure(s)

 

ARTICLE 20

SECTION A:   ELECTION

Sub-Section:

  1. There shall be an electoral commission for the screening and conduct of election whose membership shall be nominated by the General House.
  2. There shall be Electoral College compromising three (3) nominees from the members of the Association.
  3. The officers of the Association shall held for one year, but may be re-elected for a second one year provided that he/she doe not mismanage his/her previous office.
  4. Election of officers shall be by open secret ballot system.
  5. All election shall be presided over by the electoral commission’s Chairmen.
  6. The verdict of the electoral commission shall be final.
  7. Nomination form shall be obtained at the price approved by the General House which must be completed and submitted before Election Day.

 

SECTION B:             SEASON OF ELECTION

Sub-Section:

  1. The General election of the Association shall be held at the end of every year.
  2. In a situation when the end of year is not conducive for election conduct, a caretaker committee shall be set up to administer the Association before the next election. The swearing in of the official elect shall be next meeting after election.

 

SECTION C:     QUALIFICATIONS FOR THE POSTS

Sub-Section:

  1. The posts of the President and Treasurer shall be finalist only.
  2. Other posts are qualified to any legal members irrespective of their level of education.
  • The office of the President shall not be continuity or re-contest again by the same person.
  1. All intending candidate(s) to be voted for, shall be a student of Okunmo

 

ARTICLE 21

SECTION A: REMOVAL, FORFEITURE, AND RESIGNATION

Sub-Section:

  1. A member of executive shall asked to resign by the Association on the group of inefficiency such decisions must be supported by the two-thirds (2/3) majority of the association.
  2. A member of the Association or an executive member can resign voluntarily by writing on the ground of poor health or other reasons.
  • The resignation letter must be considered at the General meeting of the Association after extensive debate.
  1. A resigning officer must be prepared a comprehensive report of his activities, which must be submitted to the association.
  2. An officer can vote out of office for non-performance by 2/3 (two-thirds) majority of the Association.
  3. Officer shall be declared to have forfeited his/her seat if the year runs to an end.
  • An elective office becomes vacant when the officer dies, the officer resigns.
  • There shall be bye-election whom any post was vacant; the procedures shall be the same article 20 of section A.

 

ARTICLE 22

SECTION A:

Sub-Section:

  1. General meeting shall hold at least three times in a year.
  2. Emergency meeting shall however hold when necessary, by the president through the secretary and public relation officer.
  3. Executives meeting [s] shall hold when necessary
  4. The president shall preside over both the executive and general meeting.
  5. The duration of the meeting shall not be more than three hours except when there are urgent matters to be discussed.
  6. The official language shall be:
  • English language
  • Yoruba language
  • Ikale dialect
  1. g) Only members of the association shall eligible to attend both the general and executive meeting of the association, except such person(s)was duly invited to attend the meeting.
  2. French leave,making noise, reading of news paper, ringing of handset and answering of call or like at the meeting is shall pay fifty (#5o) naira fines.
  3. Lateness after the reading of the minutes shall liable to a fine of #5o (fifty) naira.
  4. Fighting during or immediately after meeting shall liable to a fine of #5oo (five hundred) naira.

 

ARTICLE 23

SECTION A:     PATRON

Sub-Section:

  1. There shall be patron(s) for the association to be appointed by the executives subjected to the approval of general house
  2. The Oba of Okunmo shall be grand patron of the association
  • The association shall appoint a reputable man as patrons of the association
  1. They shall give moral and financial support to the association
  2. They shall assist the association in terms of their physical presence
  3. They shall perform other roles as demanded by the association
  • A candidate shall be deemed duly of appointed a patron if he scores two-thirds (2/3) of the votes of members present at the general house.

 

 

 

 

 

SECTION B:                 PATRONESS

Sub-Section:

  1. There shall be patronesses for the association to be appointed by the executives subjected to the approval of the general house
  2. The association shall appoint a reputable woman as patronesses for the association
  • They shall give moral and financial support to the association
  1. They shall assist the association in terms of their physical presence
  2. A candidate shall be deemed duly appointed a patroness if she scores two-thirds (2/3)of the votes of members present at the general house
  3. They shall perform other roles as demanded by the association

 

SECTION C:         ADVISERS

Sub-Section:

  1. There shall be advisers for the association to be appointed by the executives subjected to the approval of the general house
  2. The association shall appoint a reputable person as advisers for the association
  3. They shall give advice,moral and financial support
  4. They shall assist the association in terms of their physical presence
  5. A candidate shall be deemed duly appointed a adviser if he or she scores two-third(2/3) of the votes of members present at the general house
  6. They shall perform other roles as demanded by the association

 

SECTION D: SPIRITUAL LEADERS

Sub-Section:

  1. There shall be spiritual leaders for the association to be appointed by the executive subjected to the approval of the association
  2. They shall give moral, financial and spiritual guidance to the association
  • They shall assist the association in terms of their physical presence.
  1. The association shall appoint reputable and god fearing persons as spiritual leaders for the association.
  2. A candidate shall deemed duly appointed a spiritual leaders if he /she scores two- third (2/3)of the votes of members present at the general house.
  3. They shall perform other roles as demanded by the association.

 

ARTICLE 24

SECTION A:    AMENDMENTS

Sub-Section:

  1. The constitution shall only be amended by the votes of two-third (2/3) majority of the member of the Association present at the General meeting of the Association.
  2. A written notice of the proposed amendments as the texts from any members shall be filed with the General Secretary of the Association.
  3. It shall be the duty of the General Secretary on receipt of the pressed amendment to calculate it to all the members of the Association.
  4. The notice of amendments shall be read out at meeting of the Association and shall be formerly proposed, seconded and discussed.
  5. The proposed amendments shall be passed by 2/3 (two-third) majority of the members present at the General meeting of the Association.
  6. The constitutional amendment committee shall be set up to review the constitution of the Association by the General House.
  7. Such an amendment shall come into effect on the day of its approved by the Association.

 

OATH OF OFFICE

This shall be taken by all new executives thus:

I…………………………………………………………do solemnly swear before the general house that I shall uphold the content of this constitution, to be good ambassador of the Association anywhere I find myself and not to abuse the privilege(s) conferred on me to serve the Association as the ………………………….. and that I will preserve, protect and defend the constitution of the Association and if found guilty of any offence any action(s) taken against me shall be binding, so help me God. (Amen)
